1. Agreement to Terms
By creating an account or using the CloudWizard platform at app.acloudwizard.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Description of Service
CloudWizard provides an AWS security scanning and compliance dashboard that allows you to:
- Connect your AWS account(s) via a read-only IAM role
- Run automated security scans using the Prowler framework
- View and export compliance findings against frameworks such as CIS, SOC2, PCI-DSS, and others
- Monitor your AWS security posture over time via a dashboard interface
The Service is hosted on AWS infrastructure in the ap-southeast-2 (Sydney) region.
3. Accounts and Eligibility
3.1 Account Registration
You must register for an account to use the Service. You agree to provide accurate, current, and complete information and to keep your account information updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at support@acloudwizard.com if you suspect unauthorised access to your account. CloudWizard is not liable for losses resulting from unauthorised use of your account.
3.3 Eligibility
You must be at least 18 years of age and have the legal capacity to enter into contracts to use the Service. The Service is intended for business and professional use only.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to scan AWS accounts you do not own or have explicit authorisation to scan
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble any part of the Service
- Resell or sublicense access to the Service without written consent from CloudWizard
- Use the Service to store or transmit malicious code, malware, or harmful data
- Circumvent any technical measures implemented to protect the Service
- Use the Service in a manner that violates any applicable law or regulation, including the Australian Privacy Act 1988
5. AWS Integration and IAM Permissions
5.1 Read-Only Access
By connecting your AWS account to CloudWizard, you grant the Service permission to assume a read-only IAM role in your AWS environment for the purpose of performing security scans. CloudWizard does not request or accept permissions to create, modify, or delete any AWS resources.
5.2 Your Responsibility
You are responsible for:
- Creating the IAM role with appropriate read-only permissions as specified in our documentation
- Ensuring the IAM role is scoped to the minimum permissions required
- Revoking the IAM role at any time via your AWS console if you wish to disconnect
5.3 Accuracy of Results
Security scan results are based on the Prowler framework and publicly available compliance benchmarks. Results are provided for informational purposes only. CloudWizard does not guarantee that scan results are complete, accurate, or sufficient to meet any regulatory or compliance requirement. You remain solely responsible for your organisation’s compliance posture.
6. Fees and Payment
6.1 Subscription Plans
Access to the Service is provided on a subscription basis. Current pricing is listed at www.acloudwizard.com/pricing. CloudWizard reserves the right to change pricing with 30 days’ notice.
6.2 Payment Processing
Payments are processed by Stripe, Inc. By providing payment information, you agree to Stripe’s terms and authorise us to charge your selected payment method for the applicable subscription fees.
6.3 Refund Policy
Subscription fees are non-refundable except where required by applicable law (including Australian Consumer Law). If you cancel your subscription, you will retain access until the end of your current billing period.
6.4 Free Trial / Beta Access
CloudWizard may offer free trial or beta access at its sole discretion. Free access may be terminated at any time without notice.
7. Intellectual Property
7.1 Our Property
All software, content, trademarks, logos, and materials comprising the Service are the intellectual property of CloudWizard or its licensors. These Terms do not grant you any ownership rights in the Service.
7.2 Your Data
You retain ownership of all data you bring to the Service, including AWS scan results generated from your AWS environment. You grant CloudWizard a limited licence to process your data solely for the purpose of providing the Service.
7.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant CloudWizard a royalty-free, perpetual licence to use that feedback to improve the Service.
8. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party that is designated as confidential or should reasonably be understood to be confidential. CloudWizard’s obligations regarding your data are further described in our Privacy Policy.
9. Disclaimers and Limitation of Liability
9.1 Service “As Is”
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 Limitation of Liability
To the maximum extent permitted by applicable law, CloudWizard’s total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid for the Service in the 3 months preceding the claim.
9.3 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
10. Indemnification
You agree to indemnify and hold harmless CloudWizard and its officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising out of:
- Your use of the Service in violation of these Terms
- Your violation of any applicable law or third-party rights
- Misconfiguration of your AWS IAM role or AWS environment
11. Term and Termination
11.1 Term
These Terms remain in effect while you have an active account or subscription.
11.2 Termination by You
You may cancel your subscription at any time through your account settings or by contacting support@acloudwizard.com.
11.3 Termination by CloudWizard
CloudWizard may suspend or terminate your account immediately if:
- You breach these Terms
- You fail to pay applicable fees
- Required to do so by law
11.4 Effect of Termination
Upon termination, your right to access the Service ceases. We will retain your data for 90 days post-termination in accordance with our Privacy Policy, after which it will be permanently deleted.
12. Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales. Before initiating legal proceedings, both parties agree to attempt to resolve disputes informally by contacting support@acloudwizard.com in the first instance.
13. Changes to These Terms
CloudWizard may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date of changes constitutes your acceptance.
